Fiduciary Duties of a Real Estate Agent:
A real estate broker/agent
who becomes an agent of a seller or buyer is deemed to be a fiduciary.
Other examples of fiduciaries are trustees, executors, and guardians.
As a fiduciary, a real estate broker/agent is held by law to owe
specific duties to his/her client. These specific fiduciary duties
include:
Loyalty:
This duty obligates a real estate agent
to act at all times, solely in the best interests of their client,
excluding all other interests, including their own. They should never
do anything that would weaken the position of their client.
Obedience:
The agent has a duty to promptly and
efficiently obey all lawful instructions given by their client. They
cannot exceed the scope of authority given.
Disclosure:
The agent must disclose all relevant and
material information to their client. This includes any facts affecting
the value or desirability of the property or any other information
relevant to the transaction.
Reasonable Care and Diligence:
An agent is obligated to use
reasonable care and diligence when pursuing the affairs of their
clients. The standard of care that should by expected is that of a
competent real estate professional.
Confidentiality:
An agent who has a fiduciary duty to a
client has a duty to keep all their personal and financial information
confidential.
Accounting:
The agent must account for all funds
entrusted to them on behalf of their client.
